Mark Bradford , a native of Maine, began his legal career with Owen & Davis, P.C., a hot-house litigation boutique that was acquired by Fulbright & Jaworski, L.L.P. (now Norton Rose Fulbright) in 2002, where he spent more than six years as a commercial and IP litigator. Mark Bradford, P.C. was incorporated in February 2009.
As a litigator, Mark Bradford has successfully handled all kinds of commercial disputes, as well as copyright, trademark, and trade dress infringement litigation. He has also handled many kinds of copyright and trademark matters and consultation, negotiated and drafted music, film and television contracts, options, royalty and synchronization agreements, licensing agreements, nondisclosure agreements, and development agreements, as well as bylaws, operating agreements, shareholder and investor agreements for start-ups, partnership and dissolution agreements and art trusts.
He is admitted to practice in New York State and in the U.S. Court of Appeals for the Second Circuit and the U.S. District Courts for the Southern and Eastern Districts of New York.
He is a graduate of Fordham Law School (J.D. 1998), Brown University (A.B. 1987) and Phillips Exeter Academy (1982).
He is counsel for Electronic Arts Intermix, and is Executor for the estate of the late performance and mixed-media artist, Stuart Sherman.
Most recently, Mark Bradford has:
- Litigated "naked licensing" action against national trademark holder;
- Litigated on behalf of a talent manager against former clients cast in a reality television program;
- Negotiated a settlement for early investors pushed out of a virtual reality company;
- Crafted all contracts and licensing for the documentary film, Walking The Camino: Six Ways To Santiago, directed and produced by Lydia Smith;
- Crafted all member, investor and operating agreements for start-up LLC developing and marketing a new smart phone application for the medical field;
- Negotiating and crafting innovative purchase-license agreements between a major NY art video distributor and several prominent museums and institutions around the world;
- Crafted a codicil to an artist's will creating a trust ensuring the immediate safety and preservation of all the artist's extant works at the time of his death;
- Successfully litigated and settled a critical copyright matter for the developer of a multi-million dollar application for iPhones; and
- Crafted by-laws and model artist's contract for a jazz record label and download service; also obtained and negotiating key capital investment for the company.
